highcourt ordered Swiggy Zomato to down 13 restaurants links selling pizza Dominos name

The Delhi High Court has passed an order against 13 restaurants selling pizza online under the name ‘Domino’s’ on food delivery platforms Swiggy and Zomato. The court has directed Swiggy and Zomato to remove links related to these restaurants. All the restaurants were selling food items like pizza using the trademark of Domino’s Pizza. While passing the order, Justice Anish Dayal has asked Swiggy and Zomato to comply with the instructions within a week and has also directed to inform the restaurants about this if necessary.

The names “Domnick Pizza”, “Dominic’s Pizza”, “Dominics Pizza”, “Dominic’s Pizza”, “Dominik Pizza” and “Domnik Pizza” were also being used.

The court has told the restaurants that they will not be able to use any similar mark like Domino’s. Domino’s had filed a petition in the court. It had said that its trademark was being violated.

Advocate Praveen Anand appeared on behalf of Domino’s. He argued that the restaurants were using similar or identical logos to Domino’s and were selling their pizzas etc. on Swiggy and Zomato. It was argued that the restaurants took unfair advantage of the search results. Whenever a user typed for Domino’s on the app, he would get the names of those restaurants by typing ‘DOM’, ‘DOMI’, ‘DOMIN’ etc.

The court was told that customers were confused many times because they placed orders in the belief that the outlets were being operated by Domino’s, when this was not the case at all. What is special is that no lawyer appeared on behalf of the restaurants in the case. Now Swiggy and Zomato will have to take down the links of all 13 restaurants.
