The names “Domnick Pizza”, “Dominic’s Pizza”, “Dominics Pizza”, “Dominic’s Pizza”, “Dominik Pizza” and “Domnik Pizza” were also being used.
The court has told the restaurants that they will not be able to use any similar symbol like Dominos. Domino’s had petitioned the court. Said that his trademark was being infringed.
Advocate Praveen Anand appeared on behalf of Domino. He argued that the restaurants were using symbols similar or similar to those of Domino’s and were selling their pizzas etc. on Swiggy and Zomato. It was said in the argument that the restaurants took advantage of the search results. Whenever a user typed for Domino’s on the app, he would get the names of those restaurants by typing ‘DOM’, ‘DOMI’, ‘DOMIN’ etc.
The court was told that customers were sometimes confused because they placed orders in the belief that the outlets were operated by Domino’s, which was not the case. The special thing is that no lawyer appeared on behalf of the restaurants in the case. Now Swiggy and Zomato will have to down the links of all 13 restaurants.
